These Terms of Use ("Terms") govern your use of the website at riviushealth.com, including the practice lookup, report pages and any content on it (together, the "Site"). The Site is operated by Rivius Health ("Rivius", "we", "us"), at .
By using the Site, you agree to these Terms. If you use the Site for a practice or other organisation, you confirm that you may accept these Terms for it. If you do not agree, please do not use the Site.
1. Who the Site is for
The Site is for people who work for or advise medical practices and other health care providers in the United States. It is a business website, not a consumer service. You must be at least 18 years old to use it.
2. The Site is information, not advice
- Not legal advice. Rivius is not a law firm and does not give legal advice. Nothing on the Site creates an attorney-client relationship. For legal questions, talk to a lawyer.
- Not a promise of results. Figures on the Site, including practice reports, estimates of amounts at stake, sample claims and illustrations, are estimates or examples. Samples and illustrations are labelled as such and do not show a typical or guaranteed result. Past results do not guarantee future outcomes. Whether a claim is eligible for federal independent dispute resolution, and what an arbiter decides, depends on facts and decisions outside our control.
- Public data. Practice reports are built from public data published by the Centers for Medicare & Medicaid Services (CMS) and other public sources named on each report. That data can be incomplete, delayed or wrong, and we may make errors in processing it. We do not guarantee its accuracy. Please tell us about errors at support@riviushealth.com.
- No government affiliation. Rivius is a private company. It is not affiliated with, endorsed by or acting for CMS, the U.S. Department of Health and Human Services, the U.S. Department of Labor, the U.S. Department of the Treasury, the Office of Personnel Management, any state agency, or any certified IDR entity. Our use of public government data does not imply any endorsement.
3. Becoming a client is separate
Using the Site does not make you a client. We provide services only under a signed Service Agreement, Business Associate Agreement and Authorization. Those documents, not these Terms, govern our services, fees and the handling of patient information. If they conflict with these Terms, they control.
4. Do not send patient information through the Site
Do not enter or upload protected health information (for example, patient names, dates of birth, member IDs or claim details that identify a patient) in the lookup box, the contact form or ordinary email. Clients send that information only through the secure channels we provide after signing our Business Associate Agreement. If you send it by mistake, tell us and we will delete it from those channels.
5. Acceptable use
You agree not to:
- use the Site in a way that breaks any law or anyone else's rights;
- scrape, crawl, harvest or bulk-download data from the Site or the lookup, or use automated means to query it, except ordinary search-engine indexing of public pages;
- try to access report pages, accounts or systems you are not authorised to access, or to guess report links;
- probe, scan or test the Site's security, or interfere with its operation, including by uploading malware or overloading it;
- copy, modify, reverse engineer or resell the Site or its content, except as these Terms allow;
- use the Site or its content to harass, defame or mislead anyone, or to pretend to be Rivius or anyone else; or
- use the Site to build a competing product or dataset.
6. Accounts and passwords
If you receive login details for a client account, keep them confidential, do not share them, and tell us at once at support@riviushealth.com if you think they have been compromised. You are responsible for activity under your login, except where it results from our failure to keep our systems secure.
7. Our content and your use of it
The Site's design, text, graphics, software and reports, other than the underlying public government data, belong to Rivius or its licensors and are protected by law. You may view and print Site pages, and use a report about your own practice, for your own internal business purposes. Any other use needs our written permission. "Rivius" and our logo are our trademarks. Public government data remains public.
8. Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
9. Links to other websites
The Site links to government and other websites for sources and background. We do not control them and are not responsible for their content or privacy practices.
10. Privacy
Our Privacy Policy explains how we handle information collected through the Site.
11. Electronic communications
By contacting us or signing up, you agree that we may communicate with you electronically, and that agreements, notices and other communications we provide electronically meet any requirement that they be in writing.
12. Disclaimers
THE SITE AND ALL CONTENT, INCLUDING PRACTICE REPORTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, RIVIUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). This section does not limit liability that cannot be limited by law, and it does not apply to our services, which are governed by the Service Agreement.
14. Indemnity
If you use the Site for a business, you will defend and indemnify Rivius against third-party claims arising from your breach of these Terms or your misuse of the Site, and pay resulting reasonable costs, including reasonable attorneys' fees.
15. Changes and suspension
We may change the Site or these Terms at any time. We will post the updated Terms here with a new "Last updated" date. Changes apply from that date to later use of the Site. We may suspend or block access to anyone who breaks these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought only in the state or federal courts located in New Castle County, Delaware, and you and we consent to their jurisdiction.
17. General
These Terms, together with our Privacy Policy, are the whole agreement about your use of the Site. If any part is found unenforceable, the rest remains in effect. If we do not enforce a right, we have not waived it. You may not transfer your rights under these Terms; we may transfer ours in a merger, acquisition or sale of assets. Headings are for convenience only.
